2 nci madde kapsam\u0131ndaki t\u00fcm sa\u011fl\u0131k kurumlar\u0131nda, hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fi i\u00e7in g\u00fcvenli hizmet sunumu ve g\u00fcvenli bir ortam sa\u011flanmas\u0131na, hizmet sunumunda kalitenin art\u0131r\u0131lmas\u0131na, sa\u011fl\u0131k kurumunda hasta ve \u00e7al\u0131\u015fanlar i\u00e7in muhtemel risklerin belirlenmesine, bu risklerin giderilmesi i\u00e7in uygun y\u00f6ntem ve tekniklerin belirlenmesine ve hizmet i\u00e7i e\u011fitimler ile g\u00fcvenli hizmet sunumu ve g\u00fcvenli \u00e7al\u0131\u015fma ortam\u0131n\u0131n s\u00fcrd\u00fcr\u00fclebilirli\u011finin sa\u011flanmas\u0131na y\u00f6nelik usul ve esaslar\u0131 d\u00fczenlemektir.<\/div>\n<div><\/div>\n<div>Kapsam<\/div>\n<div><\/div>\n<div>MADDE 2 \u2013 (1) Bu Y\u00f6netmelik kamu, \u00fcniversite ve \u00f6zel sekt\u00f6r ikinci ve \u00fc\u00e7\u00fcnc\u00fc basamak sa\u011fl\u0131k kurumlar\u0131n\u0131 kapsar.<\/div>\n<div><\/div>\n<div>Dayanak<\/div>\n<div><\/div>\n<div>MADDE 3 \u2013 (1) Bu Y\u00f6netmelik, 7\/5\/1987 tarihli ve 3359 say\u0131l\u0131 Sa\u011fl\u0131k Hizmetleri Temel Kanununun 3 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (e) ve (f) bentlerine, 13\/12\/1983 tarihli ve 181 say\u0131l\u0131 Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin 43 \u00fcnc\u00fc maddesine dayan\u0131larak haz\u0131rlanm\u0131\u015ft\u0131r.<\/div>\n<div><\/div>\n<div>Tan\u0131mlar<\/div>\n<div><\/div>\n<div>MADDE 4 \u2013 (1) Bu Y\u00f6netmelikte ge\u00e7en;<\/div>\n<div><\/div>\n<div>a) Bakanl\u0131k: Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131,<\/div>\n<div><\/div>\n<div>b) \u00c7al\u0131\u015fan: Hizmetin, resm\u00ee veya \u00f6zel sa\u011fl\u0131k kurumlar\u0131nda, sa\u011fl\u0131k hizmetinin verilmesine i\u015ftirak eden b\u00fct\u00fcn sa\u011fl\u0131k meslekleri mensuplar\u0131n\u0131 ve sa\u011fl\u0131k meslekleri mensubu olmasa bile sa\u011fl\u0131k hizmetinin verilmesine sorumlu olarak i\u015ftirak eden ve hizmetin verilmesine destek sa\u011flayan kimseleri,<\/div>\n<div><\/div>\n<div>c) Daire Ba\u015fkanl\u0131\u011f\u0131: Tedavi Hizmetleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc Performans Y\u00f6netimi ve Kalite Geli\u015ftirme Daire Ba\u015fkanl\u0131\u011f\u0131n\u0131,<\/div>\n<div><\/div>\n<div>\u00e7) De\u011ferlendirici: Daire Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan g\u00f6revlendirilen Hizmet Kalite Standartlar\u0131n\u0131n sa\u011fl\u0131k kurumlar\u0131ndaki etkinli\u011fini de\u011ferlendiren ki\u015fiyi,<\/div>\n<div><\/div>\n<div>d) De\u011ferlendirme: Daire Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan sa\u011fl\u0131k kurumlar\u0131nda Hizmet Kalite Standartlar\u0131n\u0131n etkinli\u011finin \u00f6l\u00e7\u00fclmesi faaliyetini,<\/div>\n<div><\/div>\n<div>e) Hasta: Sa\u011fl\u0131k hizmetlerinden faydalanma ihtiyac\u0131 bulunan kimseyi,<\/div>\n<div><\/div>\n<div>f) Hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fi: Sa\u011fl\u0131k hizmeti sunumunda hasta ve \u00e7al\u0131\u015fanlar\u0131n zarar g\u00f6rmesine yol a\u00e7abilecek her t\u00fcrl\u00fc i\u015flem ve s\u00fcre\u00e7ler ile ilgili al\u0131nacak tedbir ve iyile\u015ftirme uygulamalar\u0131na y\u00f6nelik faaliyetleri,<\/div>\n<div><\/div>\n<div>g) Hizmet Kalite Standartlar\u0131 (HKS): Daire Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan sa\u011fl\u0131k kurumlar\u0131n\u0131n hizmet sunumuna y\u00f6nelik haz\u0131rlanan standartlar\u0131,<\/div>\n<div><\/div>\n<div>\u011f) Sa\u011fl\u0131k kurumu: Kamu, \u00fcniversite ve \u00f6zel sekt\u00f6r ikinci ve \u00fc\u00e7\u00fcnc\u00fc basamak sa\u011fl\u0131k kurumlar\u0131n\u0131,<\/div>\n<div><\/div>\n<div>ifade eder.<\/div>\n<div><\/div>\n<div>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM<\/div>\n<div><\/div>\n<div>Temel Esaslar, Hasta ve \u00c7al\u0131\u015fan G\u00fcvenli\u011fi Uygulamalar\u0131<\/div>\n<div><\/div>\n<div>Temel esaslar<\/div>\n<div><\/div>\n<div>MADDE 5 \u2013 (1) Bu Y\u00f6netmelik kapsam\u0131ndaki sa\u011fl\u0131k kurumlar\u0131; bu Y\u00f6netmelik h\u00fck\u00fcmleri do\u011frultusunda uygulama yapmak, hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fini sa\u011flamaya y\u00f6nelik gerekli faaliyetleri ger\u00e7ekle\u015ftirmek amac\u0131yla, kendi i\u00e7 d\u00fczenlemelerini yapmak ve tedbirleri almakla y\u00fck\u00fcml\u00fcd\u00fcr. Sa\u011fl\u0131k kurumlar\u0131, hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fine ili\u015fkin tedbirleri al\u0131rken ve d\u00fczenlemeleri yaparken Daire Ba\u015fkanl\u0131\u011f\u0131nca haz\u0131rlanan ve Bakanl\u0131\u011f\u0131n resm\u00ee internet sayfas\u0131nda yay\u0131mlanan Hizmet Kalite Standartlar\u0131n\u0131 esas al\u0131r.<\/div>\n<div><\/div>\n<div>Hasta g\u00fcvenli\u011fi uygulamalar\u0131<\/div>\n<div><\/div>\n<div>MADDE 6 \u2013 (1) Bu Y\u00f6netmelik kapsam\u0131ndaki sa\u011fl\u0131k kurumlar\u0131;<\/div>\n<div><\/div>\n<div>a) Hasta kimlik bilgilerinin tan\u0131mlanmas\u0131 ve do\u011frulanmas\u0131,<\/div>\n<div><\/div>\n<div>b) Hastaya uygulanacak giri\u015fimsel i\u015flemler i\u00e7in hastan\u0131n r\u0131zas\u0131n\u0131n al\u0131nmas\u0131,<\/div>\n<div><\/div>\n<div>c) Sa\u011fl\u0131k hizmeti sunumunda ileti\u015fim g\u00fcvenli\u011finin sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>\u00e7) \u0130la\u00e7 g\u00fcvenli\u011finin sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>d) Kan ve kan \u00fcr\u00fcnlerinin transf\u00fczyon g\u00fcvenli\u011finin sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>e) Cerrahi g\u00fcvenli\u011fin sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>f) Hasta d\u00fc\u015fmelerinin \u00f6nlenmesi,<\/div>\n<div><\/div>\n<div>g) Radyasyon g\u00fcvenli\u011finin sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>\u011f) Engelli hastalara y\u00f6nelik d\u00fczenlemelerin yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>hususlar\u0131nda gerekli tedbirleri al\u0131r ve d\u00fczenlemeleri yapar.<\/div>\n<div><\/div>\n<div>\u00c7al\u0131\u015fan g\u00fcvenli\u011fi uygulamalar\u0131<\/div>\n<div><\/div>\n<div>MADDE 7 \u2013 (1) Bu Y\u00f6netmelik kapsam\u0131ndaki sa\u011fl\u0131k kurumlar\u0131;<\/div>\n<div><\/div>\n<div>a) \u00c7al\u0131\u015fan g\u00fcvenli\u011fi program\u0131n\u0131n haz\u0131rlanmas\u0131,<\/div>\n<div><\/div>\n<div>b) \u00c7al\u0131\u015fanlara y\u00f6nelik sa\u011fl\u0131k taramalar\u0131n\u0131n yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>c) Engelli \u00e7al\u0131\u015fanlara y\u00f6nelik d\u00fczenlemelerin yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>\u00e7) \u00c7al\u0131\u015fanlar\u0131n ki\u015fisel koruyucu \u00f6nlemleri almas\u0131n\u0131n sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>d) \u00c7al\u0131\u015fanlara y\u00f6nelik fiziksel sald\u0131r\u0131lar\u0131n \u00f6nlenmesine y\u00f6nelik d\u00fczenleme yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>hususlar\u0131nda gerekli tedbirleri al\u0131r ve d\u00fczenlemeleri yapar.<\/div>\n<div><\/div>\n<div>Hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fi ortak uygulamalar\u0131<\/div>\n<div><\/div>\n<div>MADDE 8 \u2013 (1) Bu Y\u00f6netmelik kapsam\u0131ndaki sa\u011fl\u0131k kurumlar\u0131;<\/div>\n<div><\/div>\n<div>a) Enfeksiyonlar\u0131n kontrol\u00fc ve \u00f6nlenmesi ile ilgili olarak;<\/div>\n<div><\/div>\n<div>1) Enfeksiyonlar\u0131n kontrol\u00fc ve \u00f6nlenmesine y\u00f6nelik bir program\u0131n haz\u0131rlanmas\u0131,<\/div>\n<div><\/div>\n<div>2) Hastane enfeksiyonlar\u0131n\u0131n izlenmesine y\u00f6nelik s\u00fcrveyans \u00e7al\u0131\u015fmalar\u0131n\u0131n yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>3) El hijyeninin sa\u011flanmas\u0131na y\u00f6nelik d\u00fczenlemelerin yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>4) \u0130zolasyon \u00f6nlemlerinin al\u0131nmas\u0131,<\/div>\n<div><\/div>\n<div>5) Temizlik, dezenfeksiyon ve sterilizasyon uygulamalar\u0131n\u0131n ger\u00e7ekle\u015ftirilmesi,<\/div>\n<div><\/div>\n<div>b) Laboratuvar g\u00fcvenli\u011fi ile ilgili olarak;<\/div>\n<div><\/div>\n<div>1) Biyog\u00fcvenlik d\u00fczeyine g\u00f6re gerekli \u00f6nlemlerin al\u0131nmas\u0131,<\/div>\n<div><\/div>\n<div>2) Laboratuvarda \u00e7al\u0131\u015f\u0131lan testlerin kalite kontrol \u00e7al\u0131\u015fmalar\u0131n\u0131n yap\u0131lmas\u0131,<\/div>\n<div><\/div>\n<div>3) Panik de\u011ferlerin bildiriminin sa\u011flanmas\u0131,<\/div>\n<div><\/div>\n<div>c) Radyasyon g\u00fcvenli\u011fi ile ilgili olarak; sa\u011fl\u0131k kurumlar\u0131nda g\u00f6revli t\u00fcm \u00e7al\u0131\u015fanlara, hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fi konusunda e\u011fitimlerin verilmesi,<\/div>\n<div><\/div>\n<div>f) Komitelerin kurulmas\u0131 ile ilgili olarak;<\/div>\n<div><\/div>\n<div>1) Hasta g\u00fcvenli\u011fi komitesi,<\/div>\n<div><\/div>\n<div>2) \u00c7al\u0131\u015fan g\u00fcvenli\u011fi komitesi kurulmas\u0131,<\/div>\n<div><\/div>\n<div>hususlar\u0131nda gerekli tedbirleri al\u0131r ve d\u00fczenlemeleri yapar.<\/div>\n<div><\/div>\n<div>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM<\/div>\n<div><\/div>\n<div>\u00c7e\u015fitli ve Son H\u00fck\u00fcmler<\/div>\n<div><\/div>\n<div>Sorumluluk<\/div>\n<div><\/div>\n<div>MADDE 9 \u2013 (1) Bu Y\u00f6netmelikte yer alan usul ve esaslar\u0131n kesintisiz ve etkin bir \u015fekilde uygulanmas\u0131, uygulama s\u0131ras\u0131nda tespit edilen sorun ve aksakl\u0131klar\u0131n giderilmesi i\u00e7in gerekli tedbirlerin al\u0131nmas\u0131, uygulaman\u0131n takip edilmesi ve de\u011ferlendirilmesi, ilgili sa\u011fl\u0131k kurumunun en \u00fcst amirinin sorumlulu\u011fundad\u0131r.<\/div>\n<div><\/div>\n<div>De\u011ferlendirme<\/div>\n<div><\/div>\n<div>MADDE 10 \u2013 (1) Bakanl\u0131k bu Y\u00f6netmelik kapsam\u0131ndaki sa\u011fl\u0131k kurumlar\u0131n\u0131 hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan de\u011ferlendirir. Sa\u011fl\u0131k kurumlar\u0131n\u0131n de\u011ferlendirilmesi s\u00fcrecinde Hizmet Kalite Standartlar\u0131 kullan\u0131l\u0131r. De\u011ferlendirmeler de\u011ferlendiriciler taraf\u0131ndan y\u0131lda en az bir defa Hizmet Kalite Standartlar\u0131ndan se\u00e7ilecek b\u00f6l\u00fcmler \u00fczerinden yap\u0131l\u0131r. Sa\u011fl\u0131k kurumlar\u0131n\u0131n bu kapsamda de\u011ferlendirilen b\u00f6l\u00fcmlerde yer alan hasta ve \u00e7al\u0131\u015fan g\u00fcvenli\u011fi ile ilgili standartlardan 100 \u00fczerinden en az 80 puan almas\u0131 gerekmektedir.
